End User License Agreement for NPS Image Editor and Color Picker

In order to use NPS Image Editor, you must accept the terms of this license agreement. Please read the entire agreement and indicate your acceptance below. Your use of this software implies acceptance of all terms in this agreement.

Grant of License

You may install and use this software on as many computers or devices as you wish. You may distribute the binaries to immediate acquaintances, friends, family, and coworkers. You may create an unlimited number of private (not publicly accessible) backup copies of both the installer and the installed product.

You may not host a copy of the installation binaries or a backup copy of the installed product on a publicly-accessible website, or distribute these publicly in any way (such as via a software collection on CD or DVD), without explicit written permission from the author. If you are interested in this type of distribution, please contact nps@nookkin.com.

Software Gratis

This software is provided gratis, or "free as in beer". You should not be charged anything for it (except possibly a media fee from an authorized distributor). Likewise, you may not yourself resell or make money directly from the software itself.

Software Updates

NPS will periodically check online for updates to the application, by requesting a small text file from a web server. No personally-identifiable information will be sent – only the version number and preferred update channel of the application. NPS will check for updates once after installation, and every 30 days after that by default.

No software is ever installed on your computer without your consent. You may opt out by clicking the "Options" button and choosing to disable updates.

Your Privacy

Your privacy is very important. NPS will never send any personal or personally-identifiable information without your explicit consent, nor will it "phone home" with usage statistics unless you explicitly consent to this as well.

Some features of NPS, such as the Feedback dialog, may prompt you for your name and e-mail address. This information is completely voluntarily, and will only be used to contact you if the issue is fixed – it will never be sold or used for any other purposes without your explicit consent.

This software, and all of its components unless otherwise specified, is the intellectual property of Lyosha Blinnikov ("nookkin") and is a copyrighted work. You may not reverse-engineer, perform unauthorized modifications, or use any portion of the software in your own product or compilation unless explicit permission has been given.

No Warranty

You hereby agree that you will not hold the program author, Lyosha Blinnikov ("nookkin"), liable for any damages arising from the use or misuse of this software. This includes any damage to files or to your computer. Although every effort has been made to ensure that the software operates trouble-free, it is not guaranteed to operate correctly under all circumstances or to be fit for a particular purpose. This software is provided "as is", and you use it at your own risk. ALWAYS back up your data.

Prerelease

This version of the product is a prerelease version, such as an alpha, beta, or release candidate. This means that the software is subject to change before the final version is released and may be incomplete. Do not use pre-release versions of the software in a production environment.
